* eCBoostup ("Agent") does not provide refunds or cancellations for products or services purchased. Once a client purchases the Wholesale Package, they are automatically enrolled in the FBA Agreement with the Agent. Provided that the client is in full compliance with their Amazon E-Commerce Store Management Agreement ("Amazon Agreement"), the Agent offers a 90-day buyback guarantee for unsold products that have been active in the client's Amazon store for over 90 days ("Product Buyback Program"). If the client wishes to exercise the Product Buyback Program, they must return any unsold products to the Agent's warehouse at their own expense. Subject to these conditions and provided the client is not in breach of their Amazon Agreement, the Agent will either refund the cost of the product or replace it with new inventory. Returned products must be in their original condition and packaging, and any items that show damage beyond normal wear and tear will not be accepted by the Agent. However, clients located in Alaska, Connecticut, Illinois, Iowa, Kentucky, Maryland, Minnesota, New Hampshire, Oklahoma, or South Dakota are not eligible to participate in the Product Buyback Program. Beginning September 16, 2024, the Product Buyback Program will only be available to qualifying new clients who sign an Amazon Agreement, and will no longer be offered to new clients entering into an
FBA Management Services Agreement ("FBA Agreement").
** Additionally, the Agent's Store Buyback Program is only available to clients who enter into an Amazon Agreement for a qualifying amount (the "Starting Fee") under the Wholesale Package. If a client's cumulative net profit during the first three (3) years of the Amazon Agreement (the "Initial Term") is less than the Starting Fee paid to the Agent, the client may choose to sell their store to the Agent for an amount equal to the difference between the Starting Fee and the client's cumulative net profit. They may then terminate their Amazon Agreement ("Store Buyback Program"). However, clients are not eligible for the Store Buyback Program if any of the following occurs during the Initial Term: (1) there is a significant change to Amazon's Terms and Conditions or other policies that negatively impacts the store; (2) the client does not invest at least twelve (12) times the Starting Fee in product purchases for their online store within the Initial Term; (3) the client chooses to pause or discontinue the operation of their online store for any reason; (4) the client's store is suspended by Amazon at any time; (5) the client breaches or is in default under any provision of the Amazon Agreement; or (6) the client is located in Alaska, Connecticut, Illinois, Iowa, Kentucky, Maryland, Minnesota, New Hampshire, Oklahoma, or South Dakota. Starting September 16, 2024, the Store Buyback Program will only be available to qualifying new clients who execute an Amazon Agreement and will no longer be offered to new clients who sign an FBA Agreement.
